PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY INCLUDE A BINDING ARBITRATION PROVISION AND A CLASS-ACTION WAIVER (SEE "DISPUTE RESOLUTION; ARBITRATION; CLASS-ACTION WAIVER") THAT AFFECT HOW DISPUTES ARE RESOLVED. BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THIS WEBSITE.

Definitions

Company ("We", "Us", "Our") refers to California Fish Plants, a brand operated by its parent company.
Website or Service refers to California Fish Plants, accessible at californiafishplants.com.
Affiliate means an entity that controls, is controlled by, or is under common control with a party.
Device means any device that can access the Service, such as a computer, phone, or tablet.
Terms means these Terms and Conditions, which form the entire agreement between You and the Company regarding the Service.
You means the individual or entity accessing or using the Service.
Country refers to the United States (California).

Acknowledgment

These Terms govern Your use of the Service and form the agreement between You and the Company. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Our Privacy Policy. They apply to all visitors and users.

You represent that You are at least 18 years old. The Company does not permit anyone under 18 to use the Service.

Acceptable Use

The Service and its data, compilations, maps, and content are Ours. You agree that You will NOT, and will not permit others to:

Scrape, crawl, harvest, "data mine," or use any automated means to access, copy, or collect Content or data from the Service;
Copy, reproduce, republish, resell, sublicense, distribute, or create derivative works from the Service or its Content, in whole or in part, for any commercial purpose;
Bypass, disable, or interfere with security, access controls, gating, or rate limits, or attempt to access Pro features or data without proper entitlement;
Reverse engineer, decompile, or attempt to derive the source or underlying data structures of the Service;
Use the Service to build, train, or populate a competing product, dataset, or model;
Introduce malware, overload or disrupt the Service, or use it in any unlawful manner or in violation of these Terms.

The Company may investigate and take any action it deems appropriate for violations, including terminating access and pursuing legal remedies.

Intellectual Property

Except for materials supplied by Our partners with permission, the Service and all of its Content, including the California Fish Plants name, logo, text, data compilations, maps, and design, are owned by the Company or its licensors and are protected by United States and international intellectual property laws. No rights are granted to You except the limited right to access and use the Service for Your own personal, non-commercial use in accordance with these Terms.

If You believe Content on the Service infringes Your copyright, email Us at hello@californiafishplants.com with a description of the work, its location on the Service, and Your contact information. We will review and respond.

Pro Account and Pro Access

The Service may offer "Pro" features, including but not limited to Pro Maps, exclusive content, and early access to new features ("Pro Features"). Pro access is a discretionary, complimentary benefit, not a paid product, and is subject to the following:

No Automatic Entitlement. Pro access is granted at the Company's sole discretion. Purchases from Our shop may result in Pro access being granted, but this is not automatic and not guaranteed. The Company is under no obligation to provide any specific amount of Pro access or any specific Pro Features in exchange for any purchase or at all.
Not a Purchased Service. Pro access is provided as a bonus. The Company currently charges no fee for Pro access itself. Any product purchased from Our shop is a purchase of that product, not a purchase of Pro access.
Variable Duration. The duration of Pro access may vary at the Company's sole discretion. Promotional bonuses may be offered, modified, or discontinued at any time without notice.
Revocation. The Company may revoke, suspend, or terminate Pro access at any time, for any reason, including suspected abuse, violation of these Terms, or account sharing. No refund, credit, or compensation will be provided.
Returns and Chargebacks. If a shop purchase that resulted in Pro access is later refunded, returned, or charged back, the associated Pro access will be revoked immediately.
Account Sharing Prohibited. Pro access is for individual accounts only. Sharing credentials or Pro access is prohibited and may result in termination.
No Vested Right. Pro Features are a privilege, not a right. The Company may modify, limit, or discontinue Pro Features at any time without notice or liability. You have no vested right or entitlement to any Pro Features.
Feature Availability. Pro Features may vary by location and are subject to change. The Company makes no guarantee regarding their availability, accuracy, or completeness.

Map Data, Location Information, and Fishing Spots

The Service provides maps, location markers, fishing spot information, and related geographic data ("Map Data") for informational and entertainment purposes only. By using any Map Data, You acknowledge and agree:

No Guarantee of Accuracy. All Map Data is provided "AS IS" without warranty of accuracy, completeness, or reliability. It may be outdated, incorrect, incomplete, or contain errors. The Company makes no representation that any spot, location, trail, launch, parking area, or other mapped feature exists, is accessible, is safe, or is legal to access or use.
Conditions Change. Conditions, regulations, access rights, property boundaries, water levels, and road conditions change without notice. The Company has no obligation to update Map Data.
User Assumes All Risk. YOU ASSUME ALL RISK AND RESPONSIBILITY FOR ANY USE OF MAP DATA, including risks of personal injury, death, property damage, trespassing, violation of laws, fines, citations, arrest, vehicle damage, equipment loss, and any other harm.
Verify Independently. You are solely responsible for independently verifying all information, including regulations, licensing, property ownership, access rights, closures, and safety, before acting on any Map Data.
No Guarantee of Legal Access. The presence of a location does not mean You have legal permission to access it. Locations may be private, require permits, or be restricted. You are solely responsible for obtaining any necessary permissions.
Not Professional Advice. Map Data is not professional, legal, safety, or navigational advice. Do not rely on it for navigation, safety, or legal compliance.
No Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON MAP DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Fish Plant Data, Reports, and All Site Content

The Service provides fish plant information, plant schedules, fishing reports, catch data, guides, tips, recommendations, and other content ("Site Content") for informational and entertainment purposes only. By using any Site Content, You acknowledge and agree:

No Guarantee of Accuracy. All Site Content is provided "AS IS" without warranty of accuracy, completeness, timeliness, or reliability, and may be outdated, incorrect, incomplete, estimated, or contain errors.
Not Official Data. Fish plant data and schedules are NOT official government data. The Company is not affiliated with the California Department of Fish and Wildlife (CDFW) or any government agency. For official information, contact the appropriate agency directly.
No Guarantee of Fish Presence. Display of plant information does not guarantee fish are present, that planting occurred, or that quantities or dates are accurate.
Reports and Third-Party Content. Reports and other third-party or partner-supplied content may be inaccurate, exaggerated, outdated, or incomplete. The Company does not verify it and makes no representation about its reliability.
Guides and Recommendations. Guides, tips, and gear recommendations are opinions only and not professional advice. The Company makes no guarantee about fishing success or gear performance.
Regulations and Licensing. YOU are solely responsible for knowing and complying with all applicable fishing laws, regulations, and licensing requirements. Always verify current regulations with the appropriate agency before fishing.
Changes Without Notice. All Site Content is subject to change, removal, or correction at any time without notice. The Company has no obligation to update it.
User Assumes All Risk. YOU ASSUME ALL RISK AND RESPONSIBILITY FOR ANY USE OF OR RELIANCE ON SITE CONTENT, including wasted time and travel, unsuccessful trips, incorrect purchases, fines, citations, injury, and property damage.
No Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON SITE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (i) Your use of or reliance on Map Data or Site Content; (ii) Your violation of any law, regulation, or third-party right; (iii) any claim that Your use caused damage to a third party; (iv) any trespassing, property damage, regulatory violation, or unauthorized access resulting from Your use; and (v) any decision You make based on the Service.

Links to Other Websites

The Service may contain links to third-party websites or services not owned or controlled by the Company, including Our shop and partner links. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party site, and shall not be liable for any damage or loss caused by Your use of or reliance on them. We advise You to review the terms and privacy policies of any site You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason, including if You breach these Terms. Upon termination, Your right to use the Service ceases immediately.

Limitation of Liability

To the maximum extent permitted by law, the entire liability of the Company and its suppliers, and Your exclusive remedy, is limited to the amount You actually paid to the Company through the Service, or one hundred U.S. dollars ($100.00) if You have not paid anything, whichever is less.

In no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including damages for loss of profits or data, business interruption, personal injury, or loss of privacy) arising out of or related to Your use of or inability to use the Service, even if advised of the possibility of such damages and even if a remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of certain damages, so some of the above may not apply. In those states, liability is limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" with all faults and without warranty of any kind. To the maximum extent permitted by law, the Company disclaims all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade. The Company does not warrant that the Service will meet Your requirements, be uninterrupted or error-free, be accurate or current, or be free of viruses or other harmful components.

Some jurisdictions do not allow certain exclusions, so some of the above may not apply to You. In such cases the exclusions apply to the greatest extent enforceable under applicable law.

Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Informal resolution first. If You have a dispute, You agree to first contact Us at hello@californiafishplants.com and attempt to resolve it informally for at least 30 days before starting any formal proceeding.

Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to the Service or these Terms shall be resolved exclusively by final and binding arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court. The arbitration shall be conducted in the State of California or, at Your election, in Your home county within the United States, or by phone or video. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.

Jury-trial waiver. TO THE EXTENT ANY DISPUTE IS NOT ARBITRATED, YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO A JURY TRIAL.

Exceptions. Either party may bring an individual claim in small-claims court, and the Company may seek injunctive or equitable relief in court to protect its intellectual property or stop unauthorized access, scraping, or misuse of the Service.

Time limit. ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER IT AROSE, OR IT IS PERMANENTLY BARRED.

Governing Law and Venue

These Terms and Your use of the Service are governed by the laws of the State of California, excluding its conflict-of-law rules. Subject to the arbitration provision above, You agree that any permitted court proceeding shall be brought exclusively in the state or federal courts located in the State of California, and You consent to the personal jurisdiction of those courts.

United States Use

The Service is intended for users in the United States. You represent that You are not located in, and are not on any U.S. government restricted-party list of, a country subject to a U.S. government embargo.

Severability and Waiver

If any provision of these Terms is held unenforceable or invalid, it will be changed and interpreted to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect. The failure to exercise a right or require performance does not waive it.

Changes to These Terms

We may modify these Terms at any time at Our sole discretion. If a change is material, We will make reasonable efforts to provide notice. By continuing to use the Service after changes become effective, You agree to the revised Terms. If You do not agree, stop using the Service.
