Pro Account and Pro Access

The Service may offer "Pro" features, including but not limited to Pro Maps, exclusive content, and early access to new features ("Pro Features"). Pro access is granted at the sole discretion of the Company and is subject to the following terms:

  • No Automatic Entitlement. Pro access is manually granted by the Company. Purchases from our affiliated shop may result in Pro access being granted, but this is not automatic and is not guaranteed. The Company is under no obligation to provide any specific amount of Pro access time or features in exchange for any purchase.
  • Variable Duration. The duration of Pro access granted may vary at the Company's sole discretion. The Company may offer promotional multipliers or bonuses at any time, which may be modified or discontinued without notice.
  • Revocation of Access. The Company reserves the right to revoke, suspend, or terminate Pro access at any time, for any reason, including but not limited to suspected abuse, violation of these Terms, account sharing, or any other conduct the Company deems inappropriate. No refund, credit, or compensation will be provided upon revocation.
  • No Refunds. If a purchase that resulted in Pro access being granted is subsequently refunded, returned, or charged back, the associated Pro access will be immediately revoked. No partial refunds or credits will be issued for unused Pro access time.
  • Account Sharing Prohibited. Pro access is granted to individual accounts only. Sharing account credentials or Pro access with others is strictly prohibited and may result in immediate termination of Pro access and/or Your account.
  • No Rights or Entitlement. You acknowledge that Pro Features are provided as a privilege, not a right. The Company may modify, limit, or discontinue Pro Features at any time without notice or liability. You have no vested right or entitlement to any Pro Features, regardless of any purchases made or Pro access previously granted.
  • Feature Availability. Pro Features may vary by location and are subject to change. The Company makes no guarantees regarding the availability, accuracy, or completeness of any Pro Features.

Map Data, Location Information, and Fishing Spots

The Service provides maps, location markers, fishing spot information, and related geographic data ("Map Data") for informational and entertainment purposes only. By using any Map Data, You expressly acknowledge and agree to the following:

  • No Guarantee of Accuracy. All Map Data is provided "AS IS" without any warranty of accuracy, completeness, or reliability. Map Data may be outdated, incorrect, incomplete, or contain errors. The Company makes no representations or warranties that any fishing spot, location, trail, boat launch, parking area, or other mapped feature actually exists, is accessible, is safe, or is legal to access or use.
  • Conditions Change. Fishing conditions, regulations, access rights, property boundaries, water levels, trail conditions, road conditions, and all other factors related to Map Data are subject to change at any time without notice. The Company has no obligation to update Map Data and makes no commitment to do so.
  • User Assumes All Risk. YOU ASSUME ALL RISK AND RESPONSIBILITY FOR ANY USE OF MAP DATA. This includes, but is not limited to, risks of personal injury, death, property damage, trespassing, violation of laws or regulations, fines, citations, arrest, vehicle damage, equipment loss, and any other harm or loss that may result from relying on or using Map Data.
  • Verify Independently. You are solely responsible for independently verifying all information before acting on any Map Data. This includes verifying current fishing regulations, licensing requirements, property ownership, access rights, seasonal closures, restricted areas, safety conditions, and any other relevant factors. The Company is not responsible for Your failure to verify information.
  • No Guarantee of Legal Access. The presence of a location on our maps does not indicate that You have legal permission to access that location. Some locations may be on private property, may require permits, may be seasonally restricted, or may be otherwise inaccessible. You are solely responsible for obtaining any necessary permissions, permits, or licenses.
  • Not Professional Advice. Map Data does not constitute professional, legal, safety, or navigational advice. The Company is not a licensed guide service, surveyor, or regulatory authority. Do not rely on Map Data for navigation, safety decisions, or legal compliance.
  • Third-Party Data. Some Map Data may be derived from third-party sources. The Company makes no representations about the accuracy or reliability of third-party data and disclaims all liability for errors in such data.
  • No Liability for Map Data. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR RELIANCE ON MAP DATA, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, TRESPASSING, FINES, CITATIONS, LOST PROFITS, OR ANY OTHER LOSSES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Fish Stocking Data, Reports, and All Site Content

The Service provides fish stocking information, plant schedules, fishing reports, catch data, guides, tips, recommendations, and other fishing-related content ("Site Content") for informational and entertainment purposes only. By using any Site Content, You expressly acknowledge and agree to the following:

  • No Guarantee of Accuracy. All Site Content, including but not limited to fish stocking schedules, plant dates, stocking amounts, fish species information, catch reports, fishing tips, gear recommendations, and location guides, is provided "AS IS" without any warranty of accuracy, completeness, timeliness, or reliability. Site Content may be outdated, incorrect, incomplete, estimated, or contain errors.
  • Stocking Information is Not Official. Fish stocking data, plant schedules, and related information displayed on the Service are NOT official government data. This information may be compiled from various sources, estimated, delayed, or entirely inaccurate. The Company is not affiliated with the California Department of Fish and Wildlife (CDFW) or any other government agency. For official stocking information, You must contact the appropriate government agency directly.
  • No Guarantee of Fish Presence. The display of stocking information for any location does not guarantee that fish are present, that fish were actually stocked, that stocking occurred on the dates shown, or that the quantities shown are accurate. Fish survival rates, migration, environmental conditions, and fishing pressure all affect actual fish availability.
  • Reports and User Content. Fishing reports, catch information, and other user-generated or third-party content may be inaccurate, exaggerated, outdated, or fabricated. The Company does not verify the accuracy of reports and makes no representations about their reliability.
  • Guides and Recommendations. Fishing guides, tips, gear recommendations, and other advisory content are opinions only and do not constitute professional advice. What works in one situation may not work in another. The Company makes no guarantees about fishing success, gear performance, or the effectiveness of any techniques described.
  • Regulations and Licensing. Site Content may reference fishing regulations, seasons, limits, and licensing requirements. This information may be outdated or incorrect. YOU ARE SOLELY RESPONSIBLE for knowing and complying with all applicable federal, state, and local fishing laws and regulations. Always verify current regulations with the appropriate government agency before fishing.
  • Environmental and Safety Information. Any information about weather, water conditions, hazards, or safety is for general reference only and may be inaccurate. You are solely responsible for assessing conditions and making safe decisions.

This includes risks of wasted time and travel, unsuccessful fishing trips, incorrect gear purchases, violation of regulations, fines, citations, personal injury, property damage, and any other harm or loss.
  • No Liability for Site Content. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR RELIANCE ON SITE CONTENT, INCLUDING BUT NOT LIMITED TO DAMAGES FOR UNSUCCESSFUL FISHING TRIPS, WASTED TRAVEL, INCORRECT PURCHASES, FINES, CITATIONS, LOST PROFITS, OR ANY OTHER LOSSES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification for Map Data and Site Content

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (i) Your use of or reliance on Map Data or Site Content; (ii) Your violation of any law, regulation, or third-party right in connection with Your use of Map Data or Site Content; (iii) Any claim that Your use of Map Data or Site Content caused damage to a third party; (iv) Any trespassing, property damage, regulatory violations, or unauthorized access resulting from Your use of Map Data or Site Content; (v) Any decisions You make based on Map Data or Site Content.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
